Organisations: Entities using our platform for management, content, sales, or other services.
Customers: Individuals purchasing or interacting with services provided through the Platform.
These Terms form the entire agreement between Different Breed ® and you.
2. License to Use Platform
All intellectual property rights in the Platform, including content, trademarks, and software, remain the property of Different Breed ® or our licensors.
You are granted a limited, non-exclusive, and revocable licence to use the Platform for its intended purpose.
You may not:
Republish, sell, rent, or redistribute content from the platform.
Modify, reproduce, or exploit any platform content without our written consent.
3. Account Registration and Use
Organisations must:
Provide accurate, current, and complete account information.
Update account information as necessary.
Accounts may be suspended or terminated for:
Breaching these Terms.
Engaging in fraud, illegal activity, or misuse of the Platform.
4. Acceptable Use Policy
You agree not to:
Use the Platform unlawfully or in a manner that causes harm to us, our Organisations, or other Customers.
Introduce malicious software, automated data scraping, or attempt unauthorized access.
Transmit misleading, defamatory, or harmful content.
Circumvent the security features or interfere with Platform operations.
Violations will result in immediate account termination.
5. Subscription and Payment
Different Breed ® offers free and paid subscriptions.
No refunds are provided for:
Subscription fees.
Purchases of digital or physical products or services.
Subscriptions auto-renew unless canceled before the renewal date.
Cancellation Policy:
You may cancel your subscription at any time. Your access will remain active until the end of the billing cycle.
No pro-rata refunds are offered for mid-cycle cancellations.
6. Organisation Responsibilities
Content Accuracy: Organisations are responsible for the accuracy, legality, and timeliness of all content uploaded, including details, pricing, and policies.
Customer Support: Organisations are solely responsible for managing customer complaints, refund requests, and disputes related to their services or products.
Indemnity: Organisations agree to indemnify Different Breed ® against claims, losses, or damages arising from:
Breach of these Terms.
Misrepresentation or inaccurate content.
Customer disputes, including refunds or cancellations.
7. Customer Purchases
Purchases made through the Platform are typically digital. A valid ID or additional information may be required for access or delivery.
Refund Policy: Refunds, if applicable, are at the sole discretion of the Organisation.
Different Breed ® is not responsible for:
Service or product cancellations or postponements.
Changes to details (e.g., availability, terms).
Refusals or restrictions enforced by Organisations.
8. Dispute Resolution
Both parties agree to make reasonable efforts to resolve disputes through negotiation.
If negotiation fails, disputes will be resolved through binding arbitration under Scottish arbitration rules before pursuing legal proceedings.
9. Indemnification
Organisations and Customers agree to indemnify Different Breed ®, including its directors, affiliates, and employees, against any claim or loss resulting from:
Breach of these Terms.
Violation of laws or third-party rights.
Misuse of the Platform.
10. Limitation of Liability
The Platform is provided "as is" with no warranties of uninterrupted, error-free use.
Different Breed ® shall not be liable for:
Indirect, consequential, or incidental damages.
Cancellations, Organisation content, or disputes.
Our liability is limited to the maximum extent permitted under Scottish law.
11. Force Majeure
Different Breed ® is not liable for delays or failures caused by circumstances beyond our control, including but not limited to: natural disasters, pandemics, government actions, or war.
12. Privacy and Data Protection
Personal data will be handled in accordance with applicable data protection laws, including GDPR.

13. Assignment
We may assign or transfer our rights under these Terms without notice.
Organisations & Customers may not assign or transfer their rights without our written consent.
14. Severability
If any provision in these Terms is deemed unlawful or unenforceable, the remaining provisions remain valid and enforceable.
15. Governing Law and Jurisdiction
These Terms are governed by Scottish law.
Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
16. Updates to Terms
We reserve the right to update or modify these Terms. Changes will be effective from the date of publication. Continued use of the Platform after updates constitutes acceptance.
